1. Company Information and Acceptance of Terms

Welcome to SparkLab! These Terms of Use (“Terms”) govern your access to and use of the SparkLab website and services. SparkLab LLC (“SparkLab” or “we”) is a company registered in Delaware, USA. By accessing or using our website or services, you (the user) agree to be bound by these Terms. If you do not agree, you must not use the service.

These Terms form a legal agreement between you and SparkLab. You also agree to any additional policies referenced herein, including our Privacy Policy, which is incorporated by reference. If you are using the service on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms, and “you” will refer to that entity. You must be legally able to agree to these Terms (e.g. an adult of at least 18 years old, as described below). Please read these Terms carefully before using SparkLab’s services.

2. Description of the Service

SparkLab provides an online platform that allows users to upload Android application package (APK) files for analysis. When you upload an APK file, our system will perform a basic free analysis and provide you with an initial report. You then have the option to purchase a comprehensive report for a fee, which offers a more in-depth analysis of the APK’s contents and behaviors.

Key features of the service include:

  • APK Upload and Free Report: You can upload an Android APK file through our website. Our software will scan and analyze the file, and then generate a basic report (for example, highlighting app permissions, file hashes, or potential security issues) at no cost.

  • Optional Paid Comprehensive Report: For a more detailed examination, you may choose to upgrade to a paid comprehensive report. This report may include deeper insights, such as code analysis, security and privacy assessments, performance metrics, or other advanced analytics regarding the APK. The price for the upgrade will be shown before purchase.

  • User Interface: Results of the analysis (free or paid) are delivered via our website dashboard and/or downloadable format. You may need to create an account (as described below) to purchase or retrieve reports.

SparkLab’s service is intended for lawful, personal or internal business use. We strive to provide helpful information about your APK files, but we do not guarantee that our analysis will find every issue or that it is appropriate for any particular purpose (see Disclaimers below). The service may evolve over time, and SparkLab reserves the right to modify, add, or remove features as needed (see Section 13 on Changes to Terms and service updates).

3. User Accounts, Eligibility, and Responsibilities

Account Creation: Certain features of our service (such as purchasing comprehensive reports or saving your analysis history) may require you to create a user account. If you choose to create an account, you must provide accurate and current information (such as your name and email address). You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account.

Eligibility and Age Requirements: By using our service or creating an account, you represent that you are at least 18 years old (or the age of legal majority in your jurisdiction). The service is not intended for children under 13. If you are between 13 and 18 (or the applicable age of majority), you may use SparkLab only with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms. SparkLab does not knowingly collect personal information from children under 13, and if we become aware of such data, we will delete it. If you do not meet these age requirements, please do not use the service.

User Responsibilities: You agree to use SparkLab in a responsible manner. By using the service, you agree to the following responsibilities:

  • Provide Truthful Information: You will provide and maintain accurate, truthful, and up-to-date information about yourself during account registration and use of the service.
  • Account Security: You will keep your account credentials (username and password) confidential. Do not share your login details with others. You must promptly notify SparkLab at our support contact (see Section 13) if you suspect any unauthorized use of your account.
  • Use Your Own Account: You will not create multiple accounts to abuse the service, and you will not impersonate any other person or entity. You are responsible for all activities that occur under your account.
  • Lawful Use: You are responsible for ensuring that your use of the service (including any content you upload) complies with all applicable laws and regulations. If you upload an APK or use a report, you must do so only for legitimate, legal purposes.
  • No Transfer of Account: Your account is personal to you. You may not transfer or assign your account to any other person or entity without SparkLab’s prior written consent.

Failure to meet these responsibilities or any other provision of these Terms may result in suspension or termination of your account or access to the service (see Section 5 on Acceptable Use). You are liable for any losses or damages incurred by SparkLab due to your failure to keep your account secure or comply with these obligations.

4. Ownership of Intellectual Property (SparkLab’s Rights)

All content and materials provided through the SparkLab website and service are owned by or licensed to SparkLab LLC and are protected by intellectual property laws. This includes, but is not limited to, the software and code that operates our analysis tools, the design and layout of the website, the text, graphics, logos, trademarks, trade names, and the reports or analysis results generated by our service (collectively, “SparkLab Materials”).

SparkLab’s Rights: SparkLab retains all rights, title, and interest in and to the SparkLab Materials. Using our service does not grant you ownership of any intellectual property rights in the service or SparkLab Materials, other than the limited usage rights expressly granted by these Terms. You may not use SparkLab’s name, logos, or other trademarks without our prior written permission, except as necessary for legitimate reference to our services.

Limited License to You: Subject to your compliance with these Terms and payment of any applicable fees, SparkLab grants you a limited, revocable, non-exclusive, non-transferable license to use our service and to access the reports and analysis results we provide for your own personal or internal business purposes. This means you may view, download, and privately use the free analysis results or comprehensive report you receive for the APK you uploaded. You may not remove any proprietary notices (e.g., copyright or trademark symbols) from any reports or materials we provide.

Restrictions: Except as expressly allowed by SparkLab, you agree notto do any of the following with SparkLab Materials or the service:

  • Copy, reproduce, modify, or create derivative works based on the service or reports (beyond personal/internal use).
  • Distribute, publish, sell, or share any part of the comprehensive report or analysis provided to you, except as reasonably necessary within your own organization or for personal use. (If you need to share our report with others, such as colleagues or consultants, you should ensure they also treat it as confidential and only for internal use.)
  • Reverse engineer, decompile, or attempt to extract the source code or underlying algorithms of any part of our service or software,except to the limited extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
  • Use any of SparkLab’s trademarks, logos, or branding without written permission. This includes not using “SparkLab” or any confusingly similar name in the names of your products or services.

Any unauthorized use of SparkLab’s intellectual property or the service may result in termination of the licenses granted by these Terms and could violate applicable law.

Feedback: We welcome user feedback, ideas, or suggestions to improve our services (“Feedback”). If you choose to provide Feedback to SparkLab, you agree that SparkLab is free to use and incorporate such Feedback in our products and services, without any obligation or compensation to you. Any Feedback you provide is entirely voluntary.

5. Acceptable Use Policy

To maintain a safe and reliable service, we require all users to follow this Acceptable Use Policy. You agree NOT to misuse the SparkLab service or help anyone else to do so. In particular, when accessing or using SparkLab, you will not:

  • Violate Laws or Rights: Use the service for any unlawful purpose, or upload any content (including APK files) that is illegal, unlawful, or infringes the rights of any third party. This includes, for example, content that is defamatory, fraudulent, obscene, harassing, or that violates privacy, intellectual property, or export control laws. You must have the legal right to upload each APK file for analysis (see Section 7 on Upload License).
  • Infringe Intellectual Property: Upload, transmit, or share APK files or other content that you do not have permission to use. Do not upload pirated apps, proprietary software, or any content that violates copyrights, trademarks, trade secrets, or other intellectual property rights of others. You are responsible for ensuring you have all necessary rights to the files you submit for analysis.
  • Distribute Harmful Code Maliciously: While our service is designed to analyze potentially malicious APKs, you must not use SparkLab to distribute malware or harmful code to others. Do not attempt to use the service as a platform to spread viruses, worms, spyware, or any other harmful software. (It is acceptable to upload a suspicious or infected APK for the purpose of analysis, but the content will remain confined to our analysis environment and not be redistributed to other users.)
  • Interfere with the Service: Do not engage in any activity that could disrupt, overburden, damage, or impair the proper functioning of our website or servers. This includes no attempting to interfere with or circumvent any security or access controls of the service, no launching any form of cyber attack (such as denial-of-service attacks) against the service, and no using bots, scrapers, or automated methods to access or extract data from the service in a manner that imposes undue load or violates our usage policies.
  • Reverse Engineering or Misuse: Do not attempt to reverse engineer, decompile, or otherwise derive the source code or underlying ideas of the service (except as allowed by law). Also, do not misuse the service by attempting to exploit vulnerabilities, probe or test the vulnerability of our system without authorization, or use the service in a way that violates the spirit of these Terms.
  • Circumvent Fees or Filters: Do not attempt to circumvent any pricing or payment systems. For example, do not try to evade purchase requirements for comprehensive reports, and do not attempt to access features or systems that you have not paid for or been given access to. Similarly, if certain files or content types are restricted, do not attempt to bypass those restrictions.
  • Abuse, Harassment, or Impersonation: You will not use the service to harass or harm others. Do not impersonate any person or entity, or falsely state or misrepresent yourself (including pretending to be a SparkLab representative). Do not use the service to stalk, harass, or bully anyone.
  • Compete Unfairly: You agree not to use information from our service to directly compete with SparkLab or to build a similar or competitive analysis service in a manner that violates our rights. For example, you should not use the free analysis repeatedly to aggregate data for a competing database, nor use our reports in a way that substitutes for a paid service offered by SparkLab.
  • Submit Prohibited Data: Do not include in your uploaded APKs any highly sensitive personal data that is not necessary for the analysis. (Our service is focused on app analysis, not personal data processing.) You should not upload files containing other people’s personal data unless you have obtained consent or have a lawful basis under privacy laws. Also, do not upload any content that is subject to specific government security controls (e.g., classified information or data controlled under ITAR regulations).

Consequences of Violations: If you violate this Acceptable Use Policy or any other provision of these Terms, SparkLab may take action at our discretion. This can include removing or disabling access to offending content, suspending or terminating your account or ability to use the service, and, in serious cases, reporting you to law enforcement. We reserve the right to monitor the use of our service for compliance (while respecting your privacy as outlined in our Privacy Policy) and to investigate any suspected breach of these Terms.

If your account is terminated for violation of these Terms, you may lose access to any reports or data associated with your account (subject to our data retention policies). SparkLab is not responsible for any loss you incur due to enforcement actions related to your misconduct.

Always use the service responsibly and ethically. If you are unsure whether something is allowed, please err on the side of caution or contact SparkLab support for clarification.

6. Disclaimer of Warranties and Limitation of Liability

Disclaimer of Warranties: The SparkLab service (including the website, the APK analysis, free reports, comprehensive reports, and any other output or content) is provided on an “AS IS” and “AS AVAILABLE” basis. To the maximum extent permitted by applicable law, SparkLab disclaims all warranties and representations, whether express, implied, or statutory, regarding the service. This includes, without limitation, any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from the course of dealing or usage of trade. We do not guarantee that the service will meet your requirements or expectations, that the analysis results will be accurate, complete, or useful to you, or that the service will be uninterrupted, error-free, secure, or free of harmful components.

In particular, SparkLab makes no warranty that: (a) the information or results obtained from the APK analysis will be 100% accurate, reliable, or exhaustive; (b) any defects or errors in the service will be corrected; or (c) any uploaded files or content will not be lost, corrupted, or damaged (although we take precautions to protect user data). You understand that analyzing APK files involves automated processes and heuristics that may not identify every issue or may occasionally flag false positives/negatives. Use the information provided by SparkLab at your own risk, and always exercise independent judgment (especially before making decisions based on our reports).

Limitation of Liability: To the fullest extent permitted by law, SparkLab and its affiliates, officers, employees, agents, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or exemplary damages arising out of or related to your use of (or inability to use) the service or any SparkLab materials. This includes, but is not limited to, damages for lost profits, lost or corrupted data, lost revenue, business interruption, replacement services, or any other intangible losses, even if SparkLab has been advised of the possibility of such damages.

In no event will SparkLab’s total cumulative liability to you for all claims arising from or related to the service and these Terms exceed the greater of: (a) the total amount (if any) you paid to SparkLab for the specific service or report that gave rise to the liability, or (b) one hundred US dollars (USD $100). This limitation applies to all causes of action, whether in contract, warranty, tort (including negligence), or any other legal theory.

Exceptions and Jurisdictional Rights: Some jurisdictions do not allow the exclusion of certain warranties or the limitation/exclusion of liability for certain types of damages (for example, in the case of gross negligence, willful misconduct, personal injury or death, or violation of specific laws). Nothing in these Terms is intended to exclude or limit liability or warranties to the extent that such exclusion or limitation is prohibited by law. In particular, we do not seek to exclude liability for SparkLab’s own willful misconduct or gross negligence, or for death or personal injury caused by our negligence, to the extent such liability cannot be limited under law.

If you are a consumer in a jurisdiction that confers you specific legal rights (such as statutory warranties or certain remedies), our intent is that the required rights remain intact. In such cases, the limitations and disclaimers in these Terms apply only to the fullest extent permitted by the laws of your jurisdiction. You may also have additional rights under consumer protection law that these Terms cannot override.

By using the service, you acknowledge that SparkLab is offering the service at either no cost (for the free analysis) or at a cost that reflects these disclaimers and liability limitations. The pricing of our comprehensive report (if applicable) is set in part based on this allocation of risk. If you do not agree with the foregoing disclaimers or limitations of liability, you should not use SparkLab’s services.

7. License Grant for Uploaded Content (User Uploads)

When you upload an Android APK file or any content to SparkLab for analysis (your “Uploaded Content”), you retain any ownership rights you have in that content. SparkLab does not claim ownership of your APK files. However, to provide our service, we need certain rights to use your content. Therefore, by uploading or submitting content to SparkLab, you hereby grant SparkLab a license to use that content as described below:

  • Scope of License: You grant SparkLab a worldwide, non-exclusive, royalty-free, and sublicensable license to host, store, transfer, scan, analyze, decompile, execute, and otherwise process your Uploaded Content for the purpose of providing you with the service. This includes the right to copy your APK file to our servers, run it through our analysis tools, extract data or metadata (such as code signatures, permissions, or indicators) from it, and generate derivative data in the form of analysis results and reports.
  • Purpose of Use: SparkLab will use your Uploaded Content solely for: (a) performing the requested analysis and generating the free or paid report for your use; (b) operating, maintaining, and improving the SparkLab service (for example, improving our analysis algorithms or security measures, which may involve reviewing or using data patterns from uploaded files); and (c) complying with any legal obligations (such as scanning for known unlawful content, or cooperating with law enforcement if the content is found to be illegal, as required by law).
  • Confidentiality of Uploads: SparkLab understands that the APK you upload may contain proprietary or sensitive information (especially if it’s an app you developed or a confidential analysis). We will treat your Uploaded Content as your confidential information. This means we will not intentionally disclose the actual content of your APK or specifics of your analysis to any third party except: (a) as needed to provide the service (for instance, we might use third-party scanning engines or cloud computing services under strict confidentiality to help analyze the file); (b) with your consent; or (c) if required by law or legal process (in which case we will, if lawful, attempt to notify you). SparkLab will not publish or make your uploaded APKs or analysis results publicly available through our free service unless you explicitly share them. (We do not operate like a public malware database; each user’s uploads and reports are private to that user’s account.)
  • No Violation of Rights: You represent and warrant that you have all necessary rights and authority to upload the APK or content to SparkLab for analysis, and to grant the license above. This means: (a) You either own the APK (e.g., it’s your app) or you have obtained appropriate permissions or rights to have it analyzed by a service like SparkLab. For example, if the APK is a third-party application, you must be sure that analyzing it in this manner does not violate any license or law. (b) Your uploading and our analysis of the content will not violate any law, regulation, or rights of any person. You also agree not to upload any content that contains personal data of others unless you have a legal right to do so (see Privacy in Section 9).
  • Malware and Dangerous Content: If the APK you upload contains malicious code (malware) or other potentially harmful elements, you affirm that your purpose in uploading is to inspect and detectsuch issues (not to spread them). SparkLab’s analysis environment is sandboxed to handle malware safely, but you should not intentionally upload extremely dangerous content that could pose undue risk without contacting us first. You are responsible for any damage to our system or third parties caused by content you provide if you intentionally misuse the service.
  • Retention of Content: The license you grant is for the limited purpose of operating the service. We will retain or delete uploaded files in accordance with our data retention policies (see Section 10). You can contact us to request deletion of your uploaded content after analysis, and we will delete the file and associated data from our active systems, except for any results or data we are legally required or permitted to retain.

To clarify, SparkLab is not acquiring ownership of your APK. This license is just to allow us to do our work. The comprehensive analysis report generated by SparkLab is considered SparkLab’s intellectual property (as a derivative work of the analysis process), but we grant you a license to use that report as described in Section 4. We will not use your uploaded files for any purpose outside the scope of providing or improving our services without obtaining additional permission from you.

If you believe SparkLab has analyzed or is storing your content in a way that you did not authorize, please notify us immediately so we can address the issue.

8. Payment and Refund Terms

Certain features of SparkLab’s service (specifically, the comprehensive APK analysis report) are offered for a fee. The following terms apply to purchases and payments on our platform:

Fees and Pricing: When you choose to purchase a comprehensive report or any paid service from SparkLab, the price and terms of that purchase will be clearly indicated. All fees are listed in U.S. Dollars (USD) unless otherwise stated, and are exclusive of any taxes (if applicable) unless stated. You are responsible for any sales, use, value-added, or similar taxes that apply to your purchase, unless we have stated that a price includes such taxes. We will inform you at checkout if any additional taxes or charges apply.

Payment Process: Payments are processed via our third-party payment processors (for example, credit card processors or online payment services). By providing a payment method, you represent that you are authorized to use that method and you authorize our payment processor to charge the full amount of the purchase to that payment method. You must provide current, complete, and accurate billing information. If your payment method (e.g., credit card) expires or is invalid, it is your responsibility to update the information so we can process your transaction. We do not store your full financial information on our servers; such information is handled securely by the payment provider.

When You Are Charged: Typically, you will be charged at the time of order (for instance, when you click “Purchase” for a comprehensive report). SparkLab may provide you access to the comprehensive report only after successful payment confirmation. In the event that your payment cannot be completed or is later reversed (e.g., due to chargeback or insufficient funds), SparkLab reserves the right to cancel the delivery of the report or revoke access to it.

No Unlawful Payments: You agree not to attempt any fraudulent or unauthorized payment. If we suspect any fraud or misuse of payment information, we may cancel the transaction and possibly disable your account pending resolution.

Refund Policy: All sales of digital reports are generally final. Because the comprehensive report is a digital product that provides value immediately upon delivery, we typically do not offer refunds once the report has been generated and delivered to you. However, SparkLab wants you to be satisfied with our service. If you believe you have not received what was promised (for example, if a report was not delivered or is incomplete due to a technical error), please contact our support team. We may, at our discretion, provide a remedy such as re-performing the analysis, issuing a corrected report, or offering a refund or credit, particularly in cases of technical failure or if required by applicable law.

Cancellation Rights (EU/UK Consumers): If you are a consumer residing in the European Union, United Kingdom, or another jurisdiction with laws granting a “cooling-off” period or right of withdrawal for digital purchases, please note the following: By purchasing a comprehensive report, you request that we begin the analysis service immediately and deliver the digital content to you promptly. You acknowledge that once the report is delivered (i.e., the service has been fully performed), you lose the legal right to withdraw from or cancel your purchase under the EU/UK consumer laws. If you do not want to waive your 14-day withdrawal right, you should refrain from ordering the comprehensive report until that period has passed – however, in such a case, we cannot deliver the report to you until the withdrawal period expires. (For clarity: under EU law, digital content or services can be made available immediately if you consent to waive the withdrawal right; our ordering process is predicated on immediate delivery of the analysis report.) If you cancel a purchase before we have delivered the report and within the statutory withdrawal period, you may be entitled to a refund. We will comply with any applicable laws regarding consumer refunds and cancellations.

Billing Errors: In the event of any mistake in billing (such as being charged the wrong amount or charged multiple times), please notify us promptly. We will correct any confirmed errors, which may include issuing a credit or refund.

Upgrades or Subscriptions: (If applicable) SparkLab may in the future offer subscription plans or additional paid features. In such cases, we will provide clear terms for those plans (such as billing frequency, auto-renewal, and how to cancel). Unless otherwise specified, subscription charges will be billed in advance on a recurring basis and will auto-renew until you cancel. You can cancel a subscription according to the instructions provided in your account settings or by contacting support. If you cancel, you will typically retain access to the paid features until the end of the current billing cycle, and there will be no further charges, but no prorated refunds for the remaining period unless required by law.

By making a purchase with SparkLab, you agree to these payment and refund terms. If you have questions about a charge or believe there has been an error, contact us at our support email for assistance.

9. Data Usage and Privacy

Your privacy is important to SparkLab. Our collection, use, and disclosure of personal data in connection with the service are described in our Privacy Policy (available on our website). We strongly encourage you to read the Privacy Policy, as it is incorporated into these Terms by reference. Below is a summary of key points regarding data usage and privacy:

  • Data Collection: SparkLab may collect certain information from you when you use our service. This can include personal information such as your name, contact details (like email address), and payment information when you create an account or make a purchase. We also collect data about your use of the service, such as IP address, browser type, device information, and activity logs (e.g. upload time, analysis results). If you upload an APK file, the contents of that file (which might include code, resources, metadata, and potentially personal data embedded in the app) are processed by our system. We treat any personal data within an uploaded APK in accordance with privacy laws and our Privacy Policy.
  • Purpose of Data Use: We use the collected data to provide and improve our services. For example, we use your email to send analysis results or account notifications, your payment information to process transactions, and your usage data to monitor and enhance service performance and security. If you have opted in to receive marketing communications, we might use your contact info to send newsletters or promotions, but you can opt out at any time.
  • Legal Basis (for EU users): If you are in the European Economic Area (EEA) or United Kingdom, we process personal data based on certain legal grounds under the GDPR (General Data Protection Regulation). Typically, personal data is processed because it’s necessary to perform our contract with you (providing the service you requested), or because we have a legitimate interest (such as improving our service and ensuring security), or on the basis of your consent in some cases (e.g., for optional marketing).
  • Data Sharing: SparkLab does not sell your personal data to third parties. We may share your information with trusted third-party service providers who assist us in operating the service (for instance, cloud hosting providers, payment processors, email service providers, or analytics services). These third parties are bound by obligations to protect your data and only use it for the purposes of providing services to SparkLab. We may also disclose information if required by law, regulation, or court order (for example, in response to a subpoena or to protect our rights if a user is found uploading unlawful content).

We take steps to ensure lawful transfer of personal data, such as utilizing Standard Contractual Clauses or other legally approved mechanisms, to protect data transferred from the EU/EEA to the US. By using our service, you acknowledge that your data will be transferred to the US and other jurisdictions as necessary for the performance of the service.
  • Your Privacy Rights: Depending on your jurisdiction, you have certain rights concerning your personal data. These may include the right to access the data we hold about you, the right to rectify (correct) inaccurate data, the right to erase (delete) your data, the right to restrict or object to certain processing of your data, and the right to data portability (to obtain a copy of your data in a usable format). For example, under the GDPR (for EU users) you have all of these rights, and under various U.S. state laws (such as the California Consumer Privacy Act, CCPA) you may have rights to know, delete, or opt-out of certain data uses. SparkLab honors applicable privacy rights and will facilitate the exercise of those rights consistent with the law.
  • Exercising Your Rights: To exercise your privacy rights or make inquiries about your personal data, you can contact us using the information provided in our Privacy Policy or in the Contact section of these Terms. We may need to verify your identity before fulfilling certain requests (for instance, before providing a copy of your data or deleting data, we need to ensure it’s you making the request). We will respond to requests within the timeframe required by law. Note that some data may be exempt from deletion or access requests if we are required to keep it for legal compliance or if it has been anonymized.
  • Privacy Policy Updates: Our Privacy Policy may be updated from time to time (to reflect changes in our practices or legal requirements). We will notify users of significant changes as required (for example, via email or a notice on our site). Continuing to use the service after a Privacy Policy update signifies your acceptance of the revised privacy practices.

10. Security Practices and Data Retention

Data Security: SparkLab takes reasonable and industry-standard security measures to protect the integrity and confidentiality of your data. We employ technical, physical, and administrative safeguards aimed at protecting against unauthorized access, alteration, disclosure, or destruction of personal information and uploaded content. User Best Practices: We recommend that you keep backup copies of any important files or data. While we take precautions to protect data on our servers, SparkLab is not a backup or storage service. We cannot guarantee that your uploaded APK or analysis reports will be preserved indefinitely. For example, if you delete your account or if we terminate it for violation of terms, your data may be deleted (as described below). Always maintain your own backup of any file you upload and any report you receive if you wish to ensure long-term access.

Data Retention: SparkLab will retain personal data and content only for as long as necessary to fulfill the purposes for which it was collected, or as required by law or legitimate business purposes. In practice, our data retention approach is as follows:

  • Account Data: If you create an account, we will retain your personal information (such as your profile info and analysis history) for the duration of your account being active. If you decide to close your account, or if your account is inactive for an extended period, we may delete or anonymize your personal data in accordance with our policies. However, we may keep certain transaction records or communications as needed for legal, tax, or accounting purposes even after an account is closed.
  • Uploaded APK Files: Uploaded files and their analysis results may be stored on our servers for a certain period. For free analysissubmissions without an account, we generally do not store the file longer than needed to analyze and show the result (we might discard the file shortly after providing the report, though we may keep metadata or non-personal results for improving our service). For logged-in users or paid reports, we may store the uploaded APK and the resulting report in your account dashboard for your reference. By default, we might retain these for your later access, but you may have the ability to delete them from your account. Even if not deleted, SparkLab will not retain uploaded files longer than necessary – for instance, we might periodically purge older uploads or anonymize data to manage storage.
  • Analysis Reports: The comprehensive analysis reports you purchase may remain accessible in your account as long as your account is active, so you can revisit them. 11. Governing Law and Jurisdiction

These Terms of Use and any dispute or claim arising out of or related to the service or these Terms (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without giving effect to any conflict of law principles that would cause the laws of a different jurisdiction to apply. In addition, to the extent applicable, the federal laws of the United States may govern certain aspects (for example, intellectual property rights, or statutory protections).

Jurisdiction and Venue: You agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the SparkLab service that cannot be resolved amicably shall be brought exclusively in the state or federal courts located in the State of Delaware, USA. You consent to the personal jurisdiction of these courts and waive any objections to such jurisdiction or venue (including any objection based on inconvenient forum). This means that if you want to sue SparkLab, or SparkLab wants to sue you, such lawsuit will generally occur in a court in Delaware.

Consumers in the EU/UK or Other Jurisdictions: We acknowledge that laws in some jurisdictions provide consumers (individuals using services for personal, non-commercial purposes) with certain rights to bring legal actions in their home country and under their local law. Nothing in these Terms affects your rights as a consumer to rely on mandatory provisions of your local law. For example, if you reside in a country that provides you certain protections or requires certain disputes to be resolved in that country’s courts, those provisions may apply notwithstanding the choice of Delaware law and venue stated above. Similarly, the choice of Delaware law shall not deprive you of any consumer protections afforded under the law of your home country (per Article 6 of the EU Rome I Regulation for EU residents, as an example).

In plain language, while we designate Delaware law and courts for resolving disputes, if local law in your country grants you certain non-waivable rights or forums, those will still apply to you. SparkLab will comply with applicable consumer protection laws.

This indemnification obligation means you will defend SparkLab (if requested by us) or pay for our defense, and you will pay any settlement amounts or damages, losses, and reasonable legal fees that are incurred by the SparkLab Parties as a result of your actions or content. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you (in which case you agree to cooperate with our defense of that claim, at your expense).

Exceptions: If you are a consumer in a jurisdiction that does not allow certain indemnification obligations for consumers, or limits them, then this provision will apply to you only to the maximum extent permitted by law. It is not our intention to have an indemnification clause that deprives consumers of protections in places where such clauses are not enforceable. However, we include this clause to protect SparkLab from costs and damages that may arise due to misuse of our service or your unlawful conduct.

You agree that this indemnity will continue to apply even if you stop using the service or your account is terminated, and it will survive termination of these Terms.
